Terms of Service
Effective October 1, 2026
1. Agreement
These Terms of Service ("Terms") govern your access to and use of the AllerWatch food allergen screening service, including the website, the organization workspace, the visitor check-in pages and the mobile interfaces (together, the "Service"). By creating an account, starting a subscription or using the Service, you agree to these Terms.
If you use the Service on behalf of an organization (such as a school, childcare provider, CILA or IDD service provider), you represent that you are authorized to accept these Terms for that organization, and "you" refers to that organization.
AllerWatch is operated from 4422 N Ravenswood Ave, Chicago, IL 60640. Questions can be sent to info@allerwatch.com.
2. The Service and its limits
AllerWatch screens food items for indicators of the nine FDA major food allergens: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans and sesame, plus any additional allergens your organization restricts.
The Service is a screening tool, not a guarantee of allergen absence. Results are produced by a fixed, deterministic screening engine that examines ingredient text, "Contains" statements and precautionary wording. Results can be wrong or incomplete because product databases can be out of date, labels change without notice, photographs can be unreadable and text recognition can misread words.
You agree that final decisions about serving food to any person rest with your organization's staff, following each person's care plan, allergy action plan and physician guidance. AllerWatch does not provide medical advice.
3. Accounts and organizations
You must provide accurate account information and keep your password secure. Each organization has one or more administrators who manage members, roles, allergy profiles, facility policy and alert settings.
Roles determine what each user can do: administrators manage the organization, staff screen food at the point of arrival, and parents and family members submit pre-checks. Visitors may check food through your organization's public check-in link without an account.
You are responsible for the activity that happens under your organization's accounts and codes.
4. Subscriptions, trials and billing
New organizations start with a 30-day free trial. After the trial, the Basic plan is $299 per month for facilities with up to 10 homes, and the Multi-home plan is $499 per month for facilities with more than 10 homes, billed monthly unless otherwise agreed in writing.
Subscriptions renew automatically each month until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
We may suspend accounts that are past due after notice.
5. Acceptable use
You agree not to: misuse the Service or interfere with its operation; attempt to access another organization's data; scrape or resell the Service; use the Service to make medical or clinical decisions; or misrepresent screening results as a certification that food is safe.
You agree to use the Service only as a screening aid, to always verify against the physical package, and to train the staff, parents and volunteers who use it accordingly.
6. Your content
Your organization retains ownership of the screening records, allergy profiles, label images and other content it submits ("Your Content"). You grant AllerWatch a limited license to process and store Your Content as needed to provide the Service, including extracting text from label images.
You are responsible for having any required permissions or consents before entering information about the individuals your organization serves.
7. Third-party data
Barcode lookups rely on third-party product databases such as Open Food Facts and USDA FoodData Central. Those sources are provided "as is"; AllerWatch does not control their accuracy and does not treat any third-party source as authoritative on its own for a screening decision.
8. Alerts
When a restricted allergen is detected, AllerWatch records an alert and attempts delivery to the email addresses and webhook URLs your organization configures. Alert delivery is best-effort: a failed or delayed delivery does not excuse your organization from reviewing arrivals directly.
9. Disclaimers and liability
Except as expressly stated, the Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose.
To the fullest extent permitted by law, AllerWatch's total liability arising out of or relating to the Service is limited to the amounts you paid to AllerWatch in the twelve months before the claim. AllerWatch is not liable for indirect, incidental, special, consequential or punitive damages.
These limits do not apply where prohibited by law.
10. Termination and changes
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms or that put the Service or other organizations at risk.
We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the updated Terms.
11. Governing law and contact
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. The state and federal courts located in Cook County, Illinois have exclusive jurisdiction over disputes arising from these Terms.
